Effective September 14th, 2002, the new Act, N.J.S.A. 58:12A-62 et seq.; N.J.A.C. 7:9E; 7:18, requires that raw, untreated potable well water be tested for specific parameters as a condition for each sale of real property. Landlords are also required to comply by March, 2004.

The laboratory results must be made available to both the buyer and seller. The sample must be collected by an employee of a New Jersey certified lab and results submitted to the NJDEP electronically.

About 12 percent of New Jersey residents receive their drinking water from private wells. Statewide, this equals about one million people drinking from 400,000 private wells. It is estimated that 20,000 to 30,000 real-estate transactions per year could trigger the requirements of the new law.

A laboratory certified by the New Jersey Department of Environmental Protection (NJDEP) in drinking water methods must perform the sampling, analysis, and reporting.
